Specific Online Gaming Conditions of Use

1. Scope
These Specific Conditions govern the opening and management of an especejeux account and your participation in the games and services offered online through our website and mobile applications. They supplement our general Conditions of Use and the rules of each game; where these Specific Conditions conflict with the general Conditions, these Specific Conditions prevail for online play. By registering or by playing, you confirm that you have read, understood and accepted these Specific Conditions. We may amend them at any time, and the version published on the site is the one in effect.
2. Services and products offered
Our online games — which may include lotteries, instant games, casino-style games, sports, poker and bingo — are offered to eligible Quebec residents aged 18 and over. The selection of games, their rules, prices, prize structures and availability may change at any time, and certain games may be offered on a shared network together with other lottery operators. A transaction, play or purchase is final and binding only once it has been accepted and recorded in our central computer system; an on-screen confirmation alone does not guarantee that a transaction has been completed.
3. Regulation
Our online gaming activities are governed by the laws and regulations applicable in Quebec and are subject to the oversight of the Régie des alcools, des courses et des jeux (RACJ), in cooperation with Loto-Québec. Each game is also governed by its own rules and, where applicable, by the regulations respecting games and the regulations respecting sales-promotion contests, which form part of these conditions. 4. Eligibility
To open an account and play, you must be at least 18 years of age, be a resident of Quebec, be physically located within the province when you play, not be currently self-excluded, and not be subject to any gaming prohibition. A person may hold only one account, and accounts are strictly personal and non-transferable. We may refuse to open an account, or suspend or close an existing one, where these eligibility conditions are not met. Where an account has been suspended as a result of a prohibition, it remains closed for the duration of that prohibition.
5. Registration and account opening
When you register, you must provide accurate, complete and current information and keep it up to date, and you must use your own identity. You choose personal credentials to access your account, and you are responsible for keeping them confidential and for all activity that occurs under your account. You must notify us promptly of any loss, theft or unauthorized use of your credentials or account. We may offer limited, non-transactional accounts that can be used only to take part in certain promotions and not to play for real money.
6. Identity verification
We are required to verify your identity, age and location, and to do so we may use geolocation technology and request supporting documents at any time, including when you register, when you withdraw funds, or as part of ongoing monitoring. We may suspend access to your account, or limit deposits, play or withdrawals, until verification is complete to our satisfaction. These measures are carried out in accordance with applicable requirements, including those relating to the fight against money laundering and terrorist financing, and the information collected is handled in accordance with our Privacy Policy.
7. Deposits and limits
You can only play with funds available in your account. Accepted deposit methods may vary depending on your financial institution and are displayed at the time of deposit. You may set a weekly deposit limit, generally between $25 and $9,999; a request to raise a limit takes effect only after a 24-hour delay, while a request to reduce a limit takes effect immediately. We encourage you to set limits that reflect your budget. You are responsible for the accuracy of your banking information, and we are not responsible for delays, fees or refusals attributable to financial institutions or payment providers.
8. Withdrawals and prizes
To withdraw, you must associate a bank account or a verified payment method held in your own name; the minimum withdrawal is generally $10, except when you close your account. We may apply a processing time and may hold or decline a withdrawal where required by law, to complete identity verification, or to prevent fraud. Prizes are credited to your account in accordance with the applicable game rules; prizes above a set threshold, or those paid as an annuity, may need to be claimed in person at a designated location with valid identification and within the prescribed time limits. Unclaimed prizes are handled in accordance with the applicable rules.
9. Participation in games
You must have sufficient funds in your account to take part, and you alone are responsible for your gaming decisions. Each game has its own rules, odds and prize structure, which are available on its page; you should read them before playing. If there is any discrepancy between information shown on screen, printed from a screen or communicated verbally, and the data recorded in our central computer system concerning your participation, the recorded data prevails and determines the outcome. A play that is not completed, or a session that is interrupted, may be cancelled in accordance with the applicable rules after a set period.
10. Bonuses and promotions
Promotions, bonuses and contests are offered subject to their own specific conditions, which set out eligibility, duration, participation requirements and any wagering or play conditions that apply before related amounts can be withdrawn. Bonuses are personal, non-transferable and have no cash value unless stated otherwise. We may modify, suspend or withdraw a promotion, and may cancel a participation or recover a bonus, in the event of error, abuse, multiple accounts, fraud or technical failure. We may also exclude a person from promotions in accordance with the applicable conditions.
11. Responsible gambling and self-exclusion
Gambling should remain a form of entertainment. We provide responsible-gambling tools that you can manage from your account, including deposit and time limits and self-exclusion. You may self-exclude online or in person for a period that you choose; during that period your account is blocked, you cannot play, and we stop sending you marketing communications. 12. Account inactivity
An account that shows no activity for a prolonged period — generally about 36 months — may be treated as dormant and may be closed. Before taking any action, we will make reasonable efforts to contact you using the information on file. Any remaining balance is handled in accordance with applicable law. You can keep your account active simply by signing in or transacting from time to time.
13. Prohibited conduct
You agree not to use the site fraudulently or unlawfully, on behalf of another person, from outside the province, or while under the legal age. You agree not to use bots, scripts or other automated means, not to collude with other players, not to circumvent our security or geolocation measures, and not to upload or transmit content that is unlawful, hateful, discriminatory, violent, offensive or that infringes the rights of others. We may modify an inappropriate nickname, remove content, and suspend or close accounts that breach these conditions; we may also report unlawful conduct to the competent authorities.
14. Errors and malfunctions
If a game, transaction, display, odds or prize is affected by an obvious error or by a technical or human malfunction, it is void to the extent of the error, even if the error appeared on screen or was confirmed. In such a case we may correct the error, void the affected play and refund the corresponding stake; our records of the affected play govern. Our liability in the event of an error or malfunction is limited to refunding the amount staked on the affected play, and a malfunction voids all related pays and plays.
15. Suspension and closure
You may close your account at any time by contacting customer service. We may suspend or close an account, in whole or in part, to comply with the law or a regulatory requirement, where we suspect fraud, abuse, money laundering or multiple accounts, where you breach these conditions, or for responsible-gambling reasons. Where we close an account, any verified balance, less any amount we are entitled or required to withhold, is returned to you in accordance with applicable rules. Suspension or closure does not affect rights or obligations that arose beforehand.
16. Personal information
We collect and use your personal information to open and manage your account, verify your eligibility, process play and payments, prevent and detect fraud, produce de-identified statistics, personalize your experience, support responsible gambling, meet our legal and regulatory obligations and, with your consent, send you marketing communications. We may share it with service providers who act on our behalf under confidentiality obligations, and with regulators and authorities where the law requires. 17. Limitation of liability
To the extent permitted by law, especejeux is not liable for losses or damages resulting from system or network failures, interruptions, delays, browser incompatibility, the use of outdated software, or the failure of third-party services or financial institutions, nor for events beyond our reasonable control. We may add, modify, suspend or withdraw a game, or close the platform, at any time and without liability, except for the payment of prizes duly recorded as won. The site and games are provided "as is", and nothing in these conditions excludes any liability that cannot be excluded under applicable law.
